Terms of Service

These terms are maintained by Claim Central. They describe what Claim Central is, what it isn't, and the responsibilities of the people who use it.

The short version

  • • Claim Central is software only.
  • • Claim Central does not process buyer payments.
  • • Claim Central is not a marketplace or escrow service.
  • • Transactions occur directly between buyers and sellers.
  • • Sellers are responsible for their listings, payment methods, taxes, and fulfillment.
  • • Claim Central is independent and not affiliated with, endorsed by, or sponsored by any social network, livestream platform, marketplace, chat service, or payment provider mentioned anywhere in the product.

0. Non-affiliation & third-party trademarks

Claim Central is an independent software product. Claim Central is not affiliated with, endorsed by, sponsored by, partnered with, or in any way officially connected to Meta Platforms, Inc. (Facebook, Instagram, Threads, WhatsApp, Messenger), TikTok, Snap, X Corp., Reddit, Discord, YouTube, Google, Apple, Microsoft, Amazon, eBay, Etsy, Shopify, Whatnot, Poshmark, Mercari, Depop, PayPal, Venmo, Cash App, Zelle, Block/Square, Stripe, or any other third-party platform, marketplace, streaming service, chat service, or payment provider.

Any product names, logos, brands, and other trademarks or service marks referenced on our website or in the product are the property of their respective trademark holders. References to third-party platforms exist only to describe interoperability, compatibility, or common seller workflows — not to imply any commercial relationship, partnership, certification, or endorsement in either direction. Use of Claim Central does not grant you any rights in any third-party mark, and you must comply with the terms of any third-party service you choose to use alongside Claim Central.

If you are a rights holder and believe a reference on our site is confusing or improper, contact us at the address below and we will review it promptly.

1. What Claim Central is

Claim Central is a hosted software tool that lets sellers organize live sales, drops, breaks, popups, and other real-time selling events. Buyers can view listings and tap Claim or submit an offer. The service is provided as-is.

Claim Central is not a marketplace, auction house, broker, escrow agent, or payment processor. We do not take custody of items, funds, or shipments.

2. Payments happen off-platform

Claim Central does not process buyer payments. Sellers collect payment from buyers using their own payment method (for example, a payment link, invoice, or off-platform transfer). Any subscription fees a seller pays to Claim Central to use the software are separate from buyer/seller transactions.

Because payments happen directly between buyer and seller, Claim Central is not a party to those transactions and cannot issue refunds, chargebacks, or dispute resolutions on a seller's or buyer's behalf.

3. Seller responsibilities

By using Claim Central to sell, the seller is solely responsible for:

  • • The accuracy, legality, and description of every listing they post.
  • • Choosing and operating their own payment method.
  • • Collecting, reporting, and remitting all applicable taxes.
  • • Packing, shipping, and delivering items to buyers.
  • • Refunds, returns, and disputes with their buyers.
  • • Complying with all applicable laws, including consumer protection, sales tax, and category-specific regulations.

4. Buyer responsibilities

Buyers are responsible for reviewing listings before claiming, paying the seller directly using the method the seller specifies, and communicating with the seller about shipping, condition, or disputes.

5. Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for activity on your account. We may suspend or terminate accounts that violate these terms or misuse the service.

6. Acceptable use

Do not use Claim Central to:

  • • Sell items that are illegal to sell where you or your buyer live.
  • • Misrepresent items, prices, condition, availability, or shipping.
  • • Harass, defraud, or attempt to circumvent claim/offer mechanics.
  • • Attempt to disrupt, reverse engineer, scrape, or overload the service.
  • • Send unsolicited bulk messages ("spam") through any Claim Central communication feature, or upload contacts you do not have permission to contact.
  • • Violate the terms of any third-party platform where you share your Claim Central link — you are solely responsible for compliance with those platforms' rules.
  • • Use the service in violation of applicable export controls or sanctions, or from any jurisdiction where use of the service is prohibited by law.

6a. Prohibited & regulated items

Sellers may not use Claim Central to organize sales of items whose sale is prohibited or heavily restricted, including but not limited to: firearms, ammunition, explosives, illegal drugs or drug paraphernalia, tobacco or vaping products where age-verification is required, alcohol where licensure is required, live animals in violation of local law, human remains, stolen goods, counterfeit goods, hazardous materials, government IDs, or any item whose sale requires a license the seller does not hold. Seller alone is responsible for confirming that every listing is lawful in the seller's and buyer's jurisdiction.

6b. User content & license to operate the service

You retain ownership of the listings, photos, descriptions, and other content you submit to Claim Central ("User Content"). By submitting User Content, you grant Claim Central a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, transmit, and create technical derivatives of that content solely to operate, provide, secure, promote, and improve the service (for example, generating thumbnails, sending invoices, rendering pages, and creating limited illustrative screenshots for marketing). You represent and warrant that you have all rights necessary to grant this license and that your User Content does not infringe any third-party rights.

Claim Central, its wordmark, and its underlying software are owned by Claim Central and its licensors. Nothing in these terms grants you any right to our trademarks, code, or design.

6c. Feedback

If you send us suggestions, ideas, or feedback about the service, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use them for any purpose without obligation or attribution.

6d. Copyright & DMCA

Claim Central respects intellectual property. If you believe content on the service infringes your copyright, send a notice under 17 U.S.C. § 512(c)(3) to our designated agent at dmca@claimcentral.live. Include the required elements (identification of the work, the allegedly infringing material and its URL, your contact information, a good-faith statement, a statement under penalty of perjury, and a physical or electronic signature). We may disable access to allegedly infringing material and, in appropriate cases, terminate repeat infringers.

6e. Third-party services & integrations

The service may link to, embed, or interoperate with third-party services (payment tools, hosting, analytics, email delivery, social sharing, etc.). Those services are governed by their own terms and privacy policies, and Claim Central is not responsible for their availability, accuracy, content, security, or practices. Your use of any third-party service is at your own risk.

6f. Communications & consent

By creating an account, you consent to receive service-related communications from Claim Central (account, transactional, billing, security, and legal notices) at the email address on file. You may opt out of non-essential marketing emails at any time. If you provide a phone number for SMS features, you consent to receive service SMS at that number; standard message and data rates may apply, and you can opt out by replying STOP.

When you use Claim Central to contact your own buyers (invoices, RSVP alerts, reminders, offer messages), you — not Claim Central — are the sender for purposes of CAN-SPAM, CASL, TCPA, and equivalent laws. You represent that you have all consents required to contact those recipients and will honor unsubscribe requests promptly.

6g. Privacy

Our collection and use of personal information is described in more detail in our privacy notice (available on request while this page evolves). In summary: we collect the information you provide, minimal analytics needed to operate the service, and information from the third-party services you connect. We do not sell personal information. Sellers act as data controllers for the buyer information they collect through the service and are responsible for their own privacy disclosures to those buyers.

7. Founding member pricing

Sellers who create an account before the public launch are grandfathered as "founding sellers" and keep their published founding-tier pricing for the life of their account, provided the account remains in good standing and subscription payments do not lapse. Free-tier limits may change over time, but a free tier will remain available.

8. No warranty

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that any listing will result in a completed transaction.

9. Limitation of liability

To the maximum extent permitted by law, Claim Central is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of your use of the service or any transaction between a buyer and a seller. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the 12 months before the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Claim Central and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content or listings; (b) any transaction, communication, or dispute between you and any buyer, seller, or third party; (c) items you sell, ship, receive, or fail to deliver; (d) your taxes, licensing, and regulatory obligations; (e) your use of any third-party service alongside Claim Central; (f) your violation of these terms or any law; and (g) your violation of anyone else's rights.

10a. Assumption of risk

Selling live to a community carries risks Claim Central cannot eliminate, including buyer non-payment, chargebacks on your own payment tools, shipping loss or damage, item misrepresentation disputes, platform outages, and reputational disputes with buyers. You use the service with knowledge of these risks and agree that Claim Central is not responsible for outcomes that arise from them.

10b. Termination

You may stop using the service at any time. We may suspend or terminate your access, with or without notice, if we believe you have violated these terms, created legal or security risk for the service or other users, or if we are required to do so by law. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) survive.

10c. Governing law & venue

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Subject to the arbitration section below, any court proceeding permitted under these terms will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue there.

10d. Binding arbitration & class-action waiver

Please read this section carefully — it affects your legal rights. Except for claims for injunctive relief to protect intellectual property or for small-claims-court matters, any dispute, claim, or controversy arising out of or relating to these terms or the service will be resolved by binding individual arbitration, administered by a nationally recognized arbitration provider under its consumer arbitration rules, seated in Delaware, in the English language. Judgment on the award may be entered in any court of competent jurisdiction.

You and Claim Central each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding. The arbitrator may award relief only on an individual basis. If this class-waiver provision is held unenforceable, then the entirety of this arbitration section will be null and void, but the rest of these terms will remain in effect.

You may opt out of arbitration by emailing legal@claimcentral.live within 30 days of first accepting these terms, with your account email and the words "arbitration opt-out" in the subject.

10e. Force majeure

Claim Central is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including internet or hosting outages, third-party service failures, natural disasters, labor disputes, cyberattacks, or government action.

10f. Beta & preview features

Features labeled "beta," "preview," "early access," "founding," or similar are offered as-is, may change or be withdrawn at any time, and carry no availability, functionality, or data-retention guarantees.

10g. Miscellaneous

These terms, together with any policies referenced here, are the entire agreement between you and Claim Central regarding the service. If any provision is held unenforceable, the remainder will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our written consent; we may assign them in connection with a merger, acquisition, financing, or sale of assets. Notices to us should be sent to the contact address below.

11. Changes to these terms

We may update these terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of the service after changes take effect means you accept the updated terms.
